The Enforcement Directorate (ED) has imposed a ₹3.44 crore fine on BBC India for allegedly violating the Foreign Exchange Management Act (FEMA). The ED has also fined three BBC India directors—Giles Antony Hunt, Indu Shekhar Sinha, and Paul Michael Gibbons—₹1.14 crore each. In addition, a daily fine of ₹5,000 has been imposed from October 15, 2021, until full compliance is achieved.
Investigation Details
The investigation began in April 2023, following surveys conducted by the Income Tax Department at BBC offices in Delhi and Mumbai in February 2023. The primary allegation is that BBC India failed to adhere to the 26% foreign ownership cap mandated for digital media companies, as introduced by a government notification on September 18, 2019.
BBC's Response and Context
A spokesperson for BBC stated that the organization has not yet received the official order from the ED and will review it before taking further steps. The broadcaster reaffirmed its commitment to following legal and regulatory frameworks in India and other countries where it operates. This fine comes after previous actions by Indian authorities, including tax surveys linked to a controversial documentary on Prime Minister Narendra Modi’s handling of the 2002 Gujarat riots, which was dismissed as biased propaganda.
