‘Satire Makes Life More Meaningful’: Supreme Court Defends Freedom of Speech, Quashes FIR Against Congress MP

In a powerful statement underscoring the importance of constitutional rights, the Supreme Court of India on Friday quashed an FIR filed by Gujarat Police against Congress MP Imran Pratapgarhi, reaffirming the vital role of freedom of speech and expression in a democratic society.
A bench comprising Justices Abhay S. Oka and Ujjal Bhuyan observed that artistic expression—including poetry, satire, drama, and literature—adds depth to human life and must be protected even if it offends some sections of the public. The court’s remarks came while hearing Pratapgarhi’s plea to quash the criminal case filed over a video he posted during a mass wedding event in Gujarat.
“Views Must Be Respected Even If Disliked”: SC
“Even if a large number of persons dislike the views expressed by another, the right of that person to express the views must be respected and protected,” the court said. It added that literature, poetry, satire, films, and art “make the life of human beings more meaningful,” reinforcing the judiciary’s role in safeguarding creative freedom.
FIR Against Imran Pratapgarhi Quashed
Congress MP Imran Pratapgarhi, who serves as the national chairman of the party’s minority cell, was facing charges under sections of the Bharatiya Nyaya Sanhita for allegedly sharing a “provocative” song in a video on social media. The clip showed him walking amid flower petals while a controversial song played in the background during a public function in Jamnagar, Gujarat.
The Gujarat High Court had earlier declined to quash the FIR, citing that the investigation was still in an early stage. However, the Supreme Court’s dismissal of the case overruled this position, stating that the lyrics and context of the video did not justify criminal prosecution under the charges of promoting enmity or undermining national integration.
Kunal Kamra Controversy Adds to Free Speech Debate
The SC’s ruling comes at a time when comedian Kunal Kamra is facing backlash for his recent satirical performance aimed at Maharashtra Deputy Chief Minister Eknath Shinde. In his act, Kamra critiqued the complex political alliances in Maharashtra, mocking the splits within Shiv Sena and NCP. His punchline — “They gave one voter nine buttons, everyone got confused” — went viral online.
